Terms of Service

Welcome to DigiNexum! These Terms of Service ("TOS") govern your access to and use of DigiNexum (the "Site"), including any content, functionality, and services offered on or through the Site. By using the Site, you accept and agree to be bound by these TOS and our Privacy Policy.

You must be at least 18 years old to use our Site. You agree to use the Site only for lawful purposes and in accordance with these TOS. You agree not to use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site.

By loggin in you also create an account on our Site, you are responsible for maintaining the security of your account and the DigiID credentials to access it. You agree to notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

All content on the Site, including text, graphics, logos, images, and software, is the property of DigiNexum or our content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission of its authors.

By submitting content to our Site, you grant DigiNexum a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, publish, and distribute such content. You agree not to submit content that is illegal, offensive, or violates the rights of others.

We may suspend or terminate your access to the Site at our sole discretion, without notice, for conduct that we believe violates these TOS or is harmful to other users of the Site, us, or third parties, or for any other reason. Upon termination, all rights granted to you under these TOS will cease.

The Site is provided on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Site or the information, products, or services on the Site.

To the fullest extent permitted by law, DigiNexum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) unauthorized access to or use of your transmissions or content.

You agree to indemnify, defend, and hold harmless DigiNexum, its affiliates, officers, directors, employees, and agents, from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site.

These TOS shall be governed by and construed in accordance with the laws of Perú, without regard to its conflict of law principles. Any legal action or proceeding arising under these TOS will be brought exclusively in the federal or state courts located in Perú.

We may revise these TOS from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised TOS means that you accept and agree to the changes.
